THE UNDERMENTIONED CONDITIONS IN RESPECT OF THE HIRE OF HOLIDAY ACCOMMODATION FROM FOWEY HARBOUR COTTAGES WILL APPLY UNLESS OTHERWISE AGREED.
l. Tenancies will commence at 4.OOpm on the day of arrival and terminate at 10.30am on the day of departure.
2 [a]. A £10 Booking Fee is payable, at the time the Booking is made and deposit paid, per booking, and is not refundable. Unless at the discretion of the Agents, you are informed otherwise, such fee is payable in respect of each booking and property.
2 [b]. A Deposit of one week's rent is payable on booking [half a week's rent for a one week booking] the balance being payable at the Agents office no later than the Monday after arrival.
3 [a]. In the unfortunate event of your having to cancel your booking we regret you are responsible for the full amount of rent. Should we be able to re-let the property then your deposit/rent [but not the Booking Fee] will be refunded less a re-letting fee.
3 [b]. In view of 3 [a] above we strongly recommend you take out Holiday Cancellation Insurance independently. There are a number of suppliers who can provide you with such cover but we are able to supply you with details of a supplier of suitable cover at reasonable rates on request.
4. Where there is no Slot Meter for electricity or gas and it does not detail that these items are allowed for in the rent then a deposit of £10 per week of tenancy is payable with the balance of rent. This will be adjusted after the tenancy [by post] according to actual consumption except there will be no refund or demand when the calculation of the difference amounts to less than £1 - in such an instance you will receive no contact from us. Where there are Slot meters these are set to cover the cost of consumption only - we suggest tenants bring a supply of the stated coins with them. Even if the property has a slot meter, consumption by Night Store Heaters are not charged through the slot meter and therefore may be charged for separately by means of an account after the tenancy (except where otherwise noted in individual property descriptions).
5. Properties are let subject to the condition that they are left as found and in the same state of cleanliness as at the commencement of the tenancy, the tenant paying for all electricity/gas consumed, phone calls, oil & coal used as and where applicable, and for all breakages and any dilapidations [other than fair wear and tear]. Tenants are requested to replace any breakages of china etc. and to report any other damage to the Agents. We would remind tenants that their personal belongings are not covered by the Insurance on the property contents and therefore are at their own risk whilst in/about the property for all purposes and reasons.
6. Pets are permitted at the properties unless otherwise stated. If permitted they must not be allowed up on the furniture, must have their own 'bed' and be house trained. Please complete the relevant portion of the Booking Form. In some cases where permitted this is only subject to a payment of a £15 per dog per week fee as noted on the details.
7. All hirings are on the basis that the property is for holiday use only and no right to remain in the property exists for anyone in the party.
8. The quoted rent is payable irrespective of the number of persons occupying, the property. Only persons detailed on the Booking Form will be eligible to occupy the property unless otherwise specifically agreed.
9. If due to reasons beyond the control of the owner or ourselves [as Agents] the property booked is unavailable, all moneys will be returned immediately. We will endeavor to offer you alternative accommodation but will be under no further liability to you other than refund the moneys paid.
10. Fowey Harbour Cottages [W J B Hill & Son] act solely as Booking Agents for the owner of the holiday property specified on the Booking Form and the agreement is therefore made between
you and such owner.
The Agents will not be liable for any act, neglect or default on the part of the owner or any other person. The Agents will not be liable for any accident, damage, loss, injury, expense or inconvenience whether to person or property which the applicant or any other person may suffer arising out of, or in any way connected with the letting howsoever caused.
11. The applicant who signs the Booking Farm will be the person responsible for all matters including all acts of all members of the party specified. This person must be aged 18 or over.
12. There should be no reason for tenants to move furniture or any item in the property but, if so moved. these items should be replaced in their original positions as at the commencement of the tenancy.
13. The Owners/Agents reserve the right to reasonable access to the property during the tenancy, it necessary
14. Unless otherwise stated the properties are not supplied with Bed Linen, sheets and pillowcases or duvet cover, sheet and pillowcases] or Towels but see below for availability of hiring. In most cases undercovers are supplied to protect beds/bedding and enhance the appearance of bedrooms; they are not provided as a substitute far the tenants own linen and if used as such, a laundry charge will be made.
15. Data Protection Act 1984. We would advise that certain information about you will be held on Computer and in other forms to assist in effective handling of information and the provision of the best service.
16. All contracts for lettings through Fowey Harbour Cottages are deemed to have been made in Cornwall and are subject to English Law.
17. Except in respect of death or personal injury caused by the negligence of the Owner and/or his/her servants, the owner and his/her respective servants will not be liable for any accident damage direct or consequential loss, injury, expense or inconvenience, whether to person or property which the Guest or any other person may suffer arising out of or in any way connected with the letting howsoever caused.
18. The Agents and owners cannot be held to account for any event [private or public] being held in the area generally or the rented property specifically which may affect your occupation of the property not any building works in any neighbouring or other property.
19. In the event that you have a complaint regarding the accommodation or the service that Fowey Harbour Cottages have provided please, in the case of a minor matter, phone or call us for us to be able to attend to the situation. For more formal matters please let us have the complaint in writing. Please bear in mind that Fowey Harbour Cottages provide the service letting holiday properties and the main contract is between the owner and the client but we will take all reasonable steps to endeavor to put the matter right. In the event of the dispute not being able to be resolved we reserve the right to refer the matter (on behalf of the owner) to the local tourist board or suitable alternative whose decision shall then be full and binding on both parties.
LINEN HIRE.
As stated above unless otherwise noted, 'linen' is not provided but we can arrange for the supply or same on request. Please detail your requirements far same on the Booking Form. Unless otherwise noted or agreed the supply and charge will apply for up to two weeks
usage [but a 'change' can be hired, if required]. Order by item:
1. Double Bed [4 pillowcases & pair sheets or sheet & duvet cover] £10.
2. Single Bed [2 pillowcase & pair sheets or sheet & duvet cover] £ 7.
3. Towel 'pack' [1 bath towel, 2 hand towels 8 2 tea towels] £ 5.
Note: Bring own towels for use on the Beach etc as hire towels are not to be used for same
